Update, December 9: Bribery

Bates Troy produced a loud, annoying, harmful noise until 1:00AM yesterday.

Update, November 13


Less than a month after the mediation meeting, Bates Troy has violated the agreement. Today, they woke us up with a loud tunnel washer noise at 5:28AM. This is a flagrant violation of their commitment to operate the tunnel washer only after 6:00AM. The City of Binghamton is investigating.

Update, October 16


Residents of the Westside met with City of Binghamton and Bates Troy representatives today to discuss the Bates Troy noise problems. Bates Troy's spokesperson was their lawyer from Hinman, Howard and Kattel, LLP. Bates Troy's official position is NO:

1) NO, Bates Troy will make no further modifications to address continuing noise problems.

2) NO, Bates Troy will not commit to operating 6AM to 6PM, Monday to Friday only. Bates Troy reserves the right to work whenever they choose in case of an "emergency" -- but they get to define emergency.

3) NO, Bates Troy will not address the odor/air pollution coming from their Industrial Dry Cleaning Plant.

4) NO, Bates Troy will not hire an environmental consultant to determine whether there is harmful levels of cancer causing chemicals in our soil due to their use of PERC in the past.

1) YES, residents are still annoyed by Bates Troy's Noise

2) YES, we will continue to seek additional modifications.

3) YES, we are prepared to challenge Bates Troy's permit to expand an industrial dry cleaning plant into a high-density residential area.

We have identified a procedural error in the way the City of Binghamton granted Bates Troy their expansion permit. This error may allow us to revoke Bates Troy's expansion permit, and we intend to do so.
