Fortunately, there is an easy solution to the noise pollution problem: enforce the law. The law clearly states that the noise produced by Bates Troy is illegal. We ask only that the City of Binghamton enforce the preexisting law.
Specifically, we recommend the following:
1) The City of Binghamton Code Enforcement Office should use all powers granted to it by the Noise Ordinance to require Bates Troy to silence their noise and stop the emission of odors.
2) The Supervisor of the Office of Building and Construction should use all powers granted to it in Chapter 410-24 N. These powers include mandating that Bates Troy seek expert outside accreditation that they are complying with the law. We also urge the Supervisor of the Office of Building and Construction to recommend the revocation of Bates Troy's special use permit under the rights granted in Chapter 410-24 O.
In addition, the Mayor of the City of Binghamton has been given special abilities under Chapter 315, the Property and Building Nuisance Reform law, to deal with noise pollution. In fact, these rights are such that they may be applied separately and in addition to other laws. We therefore ask that the Mayor utilize his powers to the fullest by seeking a Permanent Injunction against Bates Troy, levy a fine and pursue the revocation of Bates Troy's special use permit.
We are fortunate to live in a time when there are numerous advanced, scientific solutions to the Bates Troy noise pollution problem. It is well within the means of Bates Troy to hire an acoustical contractor specialized in noise abatement. In a cursory search of the internet, we found several noise prevention, absorption and reduction devices offered by the aptly named controlnoise.com including: QBS-1 Blankets, NetLag Ductwrap, FBF-IM Panels, Polyurethane foam baffles, etc. Bates Troy should be required to hire a qualified contractor to provide the level of sound abatement necessary to silence their "low frequency noise" pollution.
We demand that Bates Troy cease producing the "low frequency noise" until an expert in noise abatement has found a solution. It is unfair to the community, and illegal according to the City of Binghamton, for Bates Troy to produce noise pollution for even one second.
